Article 1: Purpose and Scope

These general terms and conditions of sale apply to all sales concluded on the website: shop.mawaqit.net.

These general terms and conditions of sale (GTC) form the basis of the commercial negotiation and are always provided or handed to each buyer to enable them to place an order, or, failing that, displayed on the MAWAQIT website.

The following general terms and conditions of sale detail the rights and obligations of MAWAQIT and its customer in the context of the sale of products.

Any acceptance of the quote/order form, including the clause "I acknowledge having read and accept the attached general terms and conditions of sale," implies the buyer's unconditional adherence to these general terms and conditions of sale.

Article 2: Price

The prices of the goods sold are those in effect on the day the order is placed. In accordance with Article 293 B of the French General Tax Code, VAT is not applicable to the products sold on the website. However, the displayed prices do not include any potential delivery charges that may be added. The final price, including delivery fees, will be displayed at the time of payment.

MAWAQIT reserves the right to modify its prices at any time. However, it commits to charging for the goods ordered at the prices indicated at the time the order is placed.

 

Article 3: Discounts and Rebates

The prices proposed include any discounts or rebates that MAWAQIT may grant based on its results or on the buyer's assumption of certain services.

No discount will be granted for early payment.

Article 5: Payment Methods

Payment for orders is made:

  • Either by credit card;
  • Or via payment platforms;
  • Or in cash, particularly during MAWAQIT's participation in events.

Payments will be made at the time of the order if it is placed online.

Article 6: Software Updates

Digital products purchased on the MAWAQIT website or through a third-party website may be subject to updates. These updates are specified on the product page at the time of purchase and may also be required by law to ensure compliance. Additional updates, offering new features, designs, interfaces, and/or characteristics or making minor technical changes, may also be offered by MAWAQIT or a third party. By accepting the terms of sale, you agree to these updates, which will be carried out automatically without any action on your part. Manual updates must be installed by you, and if not done correctly or within the specified time frame, this may affect the performance or functionality of the products.

Article 7: Complaints

To make a complaint, please contact us by email at the following address: support@mawaqit.net. We will provide you with the necessary instructions to return the product and process the refund.

If the product is defective or does not match the description provided on our site, you can return the product and we will refund you in full.

Please note that complaints must be made within 30 days after receipt of the order. After this period, we will no longer accept complaints.

Article 8: Withdrawal

The customer has a 14-day period to exercise their right of withdrawal without having to provide reasons or pay any penalties, starting from the receipt of the product.

Article 9: Return and Refund Conditions

We are committed to providing quality products and ensuring customer satisfaction. If for any reason you are not satisfied with your purchase, we offer you the possibility to return it under the following conditions:

  • Return period: You have 14 days from the receipt of your order to return the product for a refund or exchange.
  • Return conditions: Products must be returned in their original condition, unused, undamaged, and in their original packaging. We recommend returning them with proof of purchase and an explanation of the reason for the return.
  • Return shipping fees: Return shipping costs are at your expense, unless the product is defective or there was an incorrect delivery.
  • Refund: The refund will be made as soon as possible, and at the latest within 14 days of receiving the returned product. The refund will be made via the same payment method used for the original purchase.
  • Exchange: If you wish to exchange a product, please contact us to inform us of your request and the reason for the exchange. We will process your request promptly.

MAWAQIT will not be held responsible for damage resulting from abnormal or abusive use of the product.

Article 10: Delivery

Delivery is made:

  • Either by home delivery,
  • Or by direct handover of the goods to the buyer, during MAWAQIT's participation in events,
  • Or by depositing the goods at the location indicated by the buyer on the order form, via MAWAQIT's partner delivery companies displayed on the website at the time of the order.

The delivery time indicated at the time of order registration is for informational purposes only and is not guaranteed, as factors beyond MAWAQIT's control may affect the delivery time.

Consequently, any reasonable delay in the delivery of the products will not entitle the buyer to:

  • Compensation,
  • Cancellation of the order.

The transport risk is borne entirely by the buyer. In the event of missing or damaged goods during transport, the buyer must make the necessary reservations on the delivery slip upon receipt of the goods.

These reservations must also be confirmed in writing within five days following delivery, by email to the following address: support@mawaqit.net.

Article 11: Installment or Deferred Payment

No installment or deferred payment will be granted.

Article 12: Retention of Title Clause

MAWAQIT retains ownership of the goods sold until full payment of the price, including principal and accessories. As such, if the buyer undergoes judicial reorganization or liquidation, MAWAQIT reserves the right to claim the unpaid goods within the framework of the collective procedure.

Article 13: Force Majeure

MAWAQIT's responsibility will not be engaged in the event of non-performance or delays in the performance of its obligations described in the general terms and conditions of sale due to a case of force majeure. Force majeure events are those that are unforeseeable, unavoidable, and irresistible, as defined by Article 1148 of the Civil Code.

Article 14: Competent Court

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Paris.
